OSHA’s New Anti-Retaliation Rule

The Occupational Safety and Health Administration (OSHA) recently instituted new electronic injury reporting and anti-retaliation rules.  The anti-retaliation provisions are part of a broader record-keeping rule that will require certain businesses to submit electronically all injury and illness data—some of which will be available to the public on the agency's website.

The rule also prohibits employers from discouraging workers from reporting an injury or illness. The final rule requires employers to inform employees of their right to report work-related injuries and illnesses free from retaliation, which can be satisfied by posting the already-required OSHA workplace poster.

Here are some of the important aspects of the new rule

  • Employers must provide anti-retaliation training.
  • Have procedures for reporting injuries and illnesses that are reasonable and that do not deter or discourage employees from reporting.
  • Employers will need to develop a system, or process, for responding to, and resolving, employee concerns.

Summer Can Be Risky Business For Your Family

With the summer months approaching, now would be a great time to review your homeowner’s and personal insurance program.  There is a large spike in auto accidents during June through August.  We offer a free review to assess your insurance needs, and we can recommend needed personal insurance coverage like a personal umbrella, cyber liability, and flood insurance.  Summer Risks Are Very Real.
Here are a few of the risks your family may face this summer:

  • Watercraft -- Remember, your personal watercraft insurance does not cover racing.  In addition, if your boat is over a certain length, you will need a separate boat policy.  Remember to have personal floatation devices for all people in the boat, and do not drink and drive your boat.  Venture beyond the geographic limits in the policy and the insurance may be nullified.
  • Travel -- If you are planning a family vacation, make sure you keep your home safe while gone.  Use timers on lights, cancel the mail and garbage, and do not post vacation pictures on social media while you are gone.
  • Swimming -- Never leave a child unattended around water.  If your child does not know how to swim, make sure they have a floatation device on at all times.
  • Bug Bites -- If you are heading outdoors, be prepared for annoying critters.  Use EPA-registered insect repellents* that contain at least 20% DEET (products include Cutter Backwoods and Off!  Deep Woods) for protection against mosquitoes, ticks, and other bugs.  Other repellents protect against mosquitoes, but may not be effective against ticks or other bugs.
  • Barbecuing -- Never leave a barbeque unattended.  Do not barbecue inside or in a garage.  If you receive a minor burn, hold the skin under cool running water for up to 15 minutes to reduce swelling or until the pain subsides. 
  • Sunburns -- Always use sunscreen, and if your skin is burned, mix one-part whole milk with one-part cool water and gently apply it into the affected areas with a washcloth.
  • Heat Stress -- You may be having fun or working in the sun, but if it is hot, keep hydrated by drink plenty of water.  Wear lightweight clothing and take breaks every hour or so.
  • Fire pits -- Fire pits are becoming increasingly popular for outdoor entertaining.  While some burn wood, others use propane or natural gas.  Keep kids at a safe distance and teach them that fire pits stay hot long after the flames go out.

The Rising Risk of Texas Flooding

Our thoughts and prayers are with our fellow Texans who have suffered during our recent flooding. We hope we all remain safe and recover quickly.

Your homeowner’s insurance does not cover the risk from flooding.  You will need to secure coverage from the National Flood Insurance Program.  This program can be secured through our office. More than 60% of the flood insurance claims that the Federal Emergency Management Agency (FEMA) receives are from flood insurance policyholders who have property outside of the mapped 100-year floodplain.

In case you have not noticed, flooding is occurring all over the country.  In addition, other conditions can alter the flood outlook, including changing climate or the effects of El Nino or La Nina.  Our community has continued risks from flooding and we want you to be informed.
Many weather experts tell us that if you are in a 100-year floodplain, or live close to waterways, you actually have about a 60% chance each year of having a flood.

Texas Barbecue Safety Tips….Don’t Get Burned!

Fire up the grill, bring on the steak, it is time to barbecue. You might think you know all you need to know about BBQ safety and grilling. But why don't you review this page, just to make sure. We want your BBQ experience to be fun and safe for the entire family. On average there are over 9,000 home fires annually directly related to barbecuing. According to the National Fire Prevention Association; 17,000 people went to the emergency room and there was $84 million in property damage in 2015 associated with barbecuing.

Home barbecue tips:

• Never BBQ inside, in a garage, on the roof or on a second story deck
• Never leave your grill unattended
• If you're using a charcoal grill, let the lighter fluid soak into the coals a few minutes before lighting them so that any vapors have time to evaporate. When you do light the coals, stand back
• Open the grill lid before you light it
• Don’t wear loose fitting clothing
• Keep a fire extinguisher outside or close by
• Make sure you use the grill 10 feet away from your house
• Have the BBQ close to a water source
• Don’t let raw meat sit out long without being chilled or cooked
• Always wash your hands before and after handling food
• Don’t over indulge in alcohol while barbecuing
• Let the grill cool down before you store or cover it

Don’t Let The Grinch Stop Your Holiday

Read This Before You Sing Any Contract!


Contracts are signed in business every day.  Contracts can include property lease agreements, equipment lease agreements, service agreements, and employment contracts.  It is an important part of your Texas business insurance and risk management program to review all contracts prior to signing.  We always recommend that you have an attorney review contracts to make sure that they comply with all state regulations.

Contract Hot Spots

  • Hold harmless -- A hold harmless agreement requires you to hold another party harmless for your actions.  While this may be appropriate in some situations, we recommend you review this against your business insurance.  Your business insurance may have coverage limitations depending on the hold harmless language.  If you must indemnify the other party, limit the indemnification as much as possible. Negotiate the same indemnification for yourself.  An attorney can also help you understand unintended consequences that might arise from using, or agreeing to, a particular clause.
  • Disputes provisions are often part of all contracts.  Make sure that the provisions state that any dispute will be managed and settled in your state of operation.
  • Confidentiality agreement.  Many times you may be providing confidential information about your business or customers.  Consider including a provision requiring them to keep the information confidential and to secure the information in a manner consistent with applicable federal and state laws.
  • Commercial or business insurance requirements should be included in every contract. If there is going to be any on-site work completed, make sure the agreement includes workers’ compensation insurance as well.

You cannot always count on your children to be responsible when taking care of their valuables. What can happen? Doors can be left unlocked, laptops can get left in the classroom, cars can get broken into, and items can be stolen.

What you need to know

 

  • A “standard homeowner’s insurance” policy does provide some coverage, but it may be limited.
  • If your student is enrolled in a college and is living in a different city they would generally be covered under your homeowner’s policy.
  • Most homeowner’s policies provide 10 percent, or $1,000, (whichever is greater) of Coverage C (Personal Property) for your property while it is at a secondary residence.
  • Your kids would be covered under the liability coverage in your homeowner’s policy.
  • If your child is renting a home or apartment with others, you may want to consider a renters policy. The concern is that roommates can create liability for you if their actions cause a loss (parties, drinking, etc). If not insured, you may expose your own liability insurance thus increasing your premiums over time.
  • If your student takes a car to college, you need to call our office or your insurance company. Depending on where they attend college, you may have to make changes to meet minimum coverage requirements for that state, which may impact your premiums.
  • Children can remain on your health policy until the age of 26.  Many colleges will offer student health insurance at a very reasonable cost. This might be a good option.
